"Rausch, equally upset with Scarinza's comments, says, "It's pretty pathetic that 41/2 months later, the state police want to secure the evidence."

She says it's comparable to the state police not searching for Maura until 36 hours after she disappeared.

"They never did a forensics study," Rausch said. "And Lt. Scarinza is providing a lot of misinformation to the public - including that she ran away to a new life; she froze to death; she committed suicide."

"When I lay awake at night," she continued, "I wonder how well Lt. Scarinza is sleeping."

A quote from John Allore on his blog 'Who Killed Teresa' John is one of the few people in this world who knows first hand what Maura's family has had to endure.

"All to familiar and really quite pathetic".

Is it possible that although Maura's dad looks broken-hearted, as any of us would, that police wondered if, with his close relationship with Maura and their late Sunday night tel call, that Fred had an inkling of Maura's plans for the next day? That police chose not to share information even with an upset father just to ensure they wouldn't compromise the investigation? I'd really like to know how many phone calls CS made to Mr. Murray between Monday night and Tuesday night. Their statements don't agree on this at all. IIRC, Fred says there was one call that he began returning Tuesday night around 6PM; CS statement said 4? Maybe CS included calls to the other family residence? There's so much stuff throughout the case that just doesn't jibe.

Say you're the responding officer. You get to the car, find out quickly it's registered to a 61 year old guy named Murray from eastern Mass. But it's got a current UMass student parking permit on it in the name of a young woman also named Murray.

It takes only a few minutes to find out this information and put it together. Normal assumption is that the father is Fred Murray and his car is normally driven, at least at UMass, by his daughter. Which was correct. This information was probably known early on, maybe before the car was towed. But the cops cannot locate Maura and they cannot locate Fred.

Biwabik has answers.

Probably way too late, but... Was the right front tire flat? Was the right front wheel way out of alignment relative to the left front wheel? Was the right front hubcap missing? Was there any yellow paint found along the bottom of the car? What was the spattered red stuff found inside the car? Wine? Soda? Tomato sauce?

Has the Royal Canadian Mounted Police been consulted or Canadian Border guards been asked if there is a record of Maura crossing into Canada? It may as well be checked - at least to eliminate the possibility. Or vice versa - U.S. Boarder people to see if she crossed.

It involves someone from Biwabik. And someone who knows Lawlor. And a bad cop from Franklin County. Among some other pieces of waste.

Johnny Martorano now read that in the mid-1960's, Stevie [Flemmi] had dismissed him as a "pimp." A report from another informant describd how Stevie had planned to murder Larry Baione and then frame Johnny for it.

One morning in Plymouth, during a lull in the hearings, Johnny walked into Robert De Luca's cell in H3.

"Robert," said Johnny, "I am going out that door before Stevie does. I am going to destroy him before he destroys me."

He had made the decision to become an informant. The next morning Johnnny was gone from the jail. Zip realized the immense danger that Johnny's defection posed to him. It was Johnny who had procured the diamond ring back in 1976 that [Jimmy Bulger] had given to Zip - his first payoff from the mobsters. Johnny had been around all those afternoons in the Marshall Street garage when [Jimmy Bulger] was bragging about his close ties to Zip - or so Johnny would soon be testifying.

Within days, one of the most loyal Bulger sycophants in the press, Mike Barnicle of the Globe, turned in one of his trademark concoctions of factual errors mixed with outright fiction. Barnicle wrote that [Johnny] Martorano had murdered three young black women in a car in 1968 - it apparently wasn't enough that he had shot three African-Americans, one of whom happened to be female. Then Barnicle quoted one of [John] Connolly's closest friends in the Boston Police Department, Eddie Walsh, as saying Martorano used blacks in Roxbury for "target practice," a statement so inflammatory that the U.S. Attorney later felt obliged to denounce it as "madness: and "fantasy."

In a strange coincidence, Barnicle's half-baked attempt to protect Zip by trashing Martorano turned out of be his final regular column for the Globe. A quarter-century of journalistic abuses had finally caught up with him and he was forced out in disgrace over other, earlier transgressions unrelated to the final Martorano column. After Barnicle's departure, the paper had to run one last lengthy correction cataloging the errors in that final piece. And the Bulgers [Billy and Jimmy] had one fewer lackey they could rely on in the media.

__________

Above from "The Brothers Bulger" by Howie Carr.

Yeah, I know, Howie Carr is not exactly a journalistic heavyweight. But he's correct about Barnicle and he's correct about Martorano, who has just been released, despite the fact that he is known to have murdered at least 20 people. Bulger, Martorano, and Barnicle. Now that Martorano's out, maybe there's a reason to fondly recall Mike Barnicle.

Its so much easier to say what one might do in a situation. But when your actually living the situation its totally different.

Choosing between stopping at Amherst and pressing on to Haverhill must have been a crap shoot. A seven mile detour could have easily resulted in a two to three hour detour of zero benefit. Maybe Fred had already talked to Maura's friends, UMass staff, etc. and decided his best efforts should be focused near the location of the car. It was his decision to make, without the benefit of 20/20 hindsight. Plus, he owned the abandoned car. It may not have been the first thing on his mind, but he did have some responsibility for the vehicle.

PART ONE:

South Florida Business Journal - by Julia Neyman

The former assistant to the chairman of the Joint Chiefs of Staff has filed a counterclaim against South Florida businessmen Douglas Zemsky and Paul Harary in relation to a stock manipulation and kickback case.

Retired Maj. Gen. Michael Davidson on Oct. 24 filed the countersuit, claiming Zemsky, of Hallandale Beach, and Harary, of Boca Raton, sold him a tainted shell company, engaged in a pump-and-dump scheme without his knowledge, and then, when the SEC caught wind of the conspiracy, tried to pin the blame on him.

Davidson is also asking a judge to look into actions by the duo's former Fort Lauderdale attorney, Jan Atlas of Adorno & Yoss.

It's the latest blow for Zemsky, 44, and Harary, 43, who pleaded guilty in a criminal case and settled a civil case after the SEC said they defrauded the customers of a Boca Raton brokerage firm of $3.8 million. Among those defrauded is an 84-year-old woman who had opened a stock account with the money she received from her son's Sept. 11 death at the World Trade Center, and a retired widow who lost $116,000, SEC documents show.

According to the SEC and U.S. Department of Justice complaints, Harary and Florida stockbroker "AF," who has since been identified in civil law suits as Anthony Fareri, acquired control of two shell companies and artificially inflated their stock prices using a pre-arranged matched trading scheme. Zemsky identified and purchased the shells: Secure Solutions Holdings (Pink Sheets: SSLX) and American Financial Holdings (Pink Sheets: AFHJ), which he renamed

Tactical Solution Partners (Pink Sheets: TTSR).

The SEC said Harary made $4.4 million, Fareri got $1 million in kickbacks and the customers, many of them elderly, were left with worthless stock.

The SEC in September settled with Harary for $4 million and Zemsky for $97,000. They have not paid the fines yet. Fareri has not been indicted, but Josh Felker, assistant director of the SEC's division of enforcement, said an investigation is ongoing.

Shortly after the SEC action, Harary and Zemsky pleaded guilty to federal wire and mail fraud charges in a Washington, D.C., court. Zemsky, who is to be sentenced on Jan. 25, faces up to 63 months in prison. Harary faces up to 78 months in prison, but his sentencing has been delayed. His plea deal requires cooperation with federal investigators in other fraud cases.

"Mr. Harary has accepted responsibility for his conduct," said his attorney, Christopher Bruno. "He cooperated to his best ability with the government and he is looking forward to putting this matter behind him."

Neither Zemsky, Harary nor Zemsky's attorney could be reached for comment.
